A mortgage instrument submitted for registration with the Tanzania Zanzibar International Register of Shipping (TZIRS) may be recognised as a Preferred Mortgage where it complies with the applicable statutory provisions governing ship mortgages and maritime security interests.
A mortgage that covers interests extending beyond the vessel itself — including property or rights ancillary to the vessel — may qualify for preferred status only to the extent permitted under governing maritime law.
Scope of Mortgage InterestA Preferred Mortgage typically constitutes a security interest over the vessel and may, where lawfully structured, extend to associated rights or appurtenances connected with the vessel’s ownership or operation.
Recognition of preferred status is subject to:
• Compliance with applicable registry and statutory requirements
• Proper execution of the mortgage instrument
• Accurate identification of the secured obligations
• Clear specification of the mortgaged property
Upon due registration in the TZIRS Register, a Preferred Mortgage:
• Establishes a legally recognised maritime security interest
• Creates a maritime lien enforceable in accordance with applicable law
• Confers priority based on the order of registration
• Provides public notice of the encumbrance
Only mortgages duly recorded in the Register shall be recognised as registered maritime interests under the Zanzibar flag.
Limitations & ComplianceWhere a mortgage instrument purports to cover assets or interests other than the vessel, such provisions shall be recognised only insofar as they are valid under the governing law of the mortgage and compatible with registry regulations.
TZIRS records the mortgage as a registry instrument but does not determine the commercial validity of contractual arrangements beyond statutory compliance.
Amendments & DischargePreferred Mortgages may be amended, assigned, discharged, or otherwise modified through duly submitted registry filings, subject to verification and approval.
