A Preferred Mortgage registered with the Tanzania Zanzibar International Register of Shipping (TZIRS) may secure obligations that bear interest as agreed between the parties to the mortgage instrument, subject to the governing law of the agreement.
The rate, calculation method, and applicable terms of interest shall be determined by the contractual provisions set out in the mortgage documentation.
Contractual Determination of InterestInterest payable under a Preferred Mortgage may include:
• Fixed or variable interest rates
• Default or penalty interest, where applicable
• Compounded or simple interest structures
• Other lawful interest arrangements recognised under the governing law
TZIRS does not prescribe commercial interest terms but records the mortgage instrument as presented, provided it satisfies statutory and registry requirements.
Effect of RegistrationRegistration of a Preferred Mortgage serves to record the secured interest against the vessel.
The Registry does not evaluate or regulate:
• The commercial reasonableness of interest rates
• Financial arrangements between the parties
• Underlying contractual disputes
Such matters remain governed by the applicable law and the terms agreed by the contracting parties.
Registry Function & Legal FrameworkThe Registry’s role is limited to the formal recording of maritime security interests.
Recognition of interest provisions arises from the mortgage instrument itself and the governing legal framework, not from Registry determination.
Parties to a mortgage transaction are responsible for ensuring that interest provisions comply with the applicable governing law and financial regulations.
